Terms & Conditions

On acceptance of our quote and payment of the progress payment, Mister Shade (‘The Supplier’) and the Customer (‘The Customer’) receiving goods or services are agreeing to the following:

  • Completion dates can vary and are reliant on the weather and suppliers.
  • Any variations to these terms must be in writing and signed by both the customer and Mister Shade.
  • Final Pricing may be subject to change pending engineer’s specifications for steelwork/footings.
  • If for any reason the customer delays work outside of Mister Shade control, we reserve the right to request a progress payment.
  • If rock, water or sand is encountered there may be additional charges.
  • It is the responsibility of the customer to notify Mister Shade of ANY underground services and their correct LOCATION-eg water,sewerage,electrical. All care will be taken but Mister Shade takes NO responsibility if underground services are encountered and damaged or relocated during excavations.
  • Tiles- All care will be taken but no responsibility will be accepted if tiles are damaged during installation. Including ceramic tiles laid on compressed fibro sheeting.
  • All invoices are made under the Building and Construction Industry Payments Act 2004 QLD
  • All materials remain the property of Mister Shade until payment has been received in full.
  • The customer will inspect all goods and workmanship and report any faults in writing within 7 days subject to acceptance by the supplier, the supplier will be limited to repairing and/or replacing any goods or workmanship at its option. Otherwise, if not notified within 7 days, the customer must pay for the goods or workmanship and the supplier will not be liable for any faults in the goods or workmanship or for any claim, damages or costs relating to the goods or workmanship and the customer will indemnify the Supplier.
  • It is the responsibility of the customer to maintain the sail once erected and keep its tension. During high winds or storms the sail should be removed. If the sail is affected in any way by the storms and severe acts of vandalism or accident (including birds) during or after the 12-month warranty period, there will be a charge for any repairs or replacements required.
  • Except as required by law, the Supplier gives no guarantee in relation to the goods other than as expressly stated in these terms and quote. The Supplier will have no liability at all for any consequential loss, injury, damage or expense suffered or incurred directly or indirectly by the Customer or the Customer’s agents or employee or any other person using the goods provided by the Supplier.
  • A 12-month workmanship warranty is issued on the date of the final installation.
  • Statutory requirements, building permits, approvals etc are the responsibility of the Customer or landowner.
  • QBCC Insurance where required must be paid for as an additional charge by the customer. This insurance is applicable to all domestic projects using any type of material where the structure attached to a building or is in excess of 10m2 and where the total cost is over $3001.00.
  • If the event that this account becomes overdue and falls outside the trading terms, Mister Shade will impose a 20% administration fee calculated daily and compound monthly of the total invoice amount payable. Mister Shade also reserves the right to refer the account to a collection agency for any outstanding amounts if the Customer continues to default in payment. All recovery costs will be paid by the Customer.
  • When undertaking insurance work, or fixing to any existing points/posts, whether seen o unseen, all existing fixing points. If these are later determined not to be acceptable, there will be a charge associated with repairing these and payable by the customer.
  • Please NOTE during the quotation process please advise if your home is TRU BLUE steel or does not have timber framing/trusses, is this may result in additional cost during installation.
